By downloading, accessing, or using the VELOX mobile application, website, or related services (collectively, the "Platform"), you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Platform. Our Privacy Policy explains how we handle personal data and forms part of your understanding of how the Platform operates.

Eligibility & Your Account

You must be at least 13 years old to use the Platform, or the minimum age required in your country if that age is higher. You agree that registration information you provide is accurate and that you will keep your credentials confidential. You are responsible for all activity under your account unless you notify us promptly of unauthorized use at support@velox.fitness.

Health, Fitness & Medical Disclaimer

VELOX provides fitness planning, workout content, and related tools for general wellness and educational purposes only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for professional healthcare. Always consult a qualified healthcare provider before starting or changing an exercise program, especially if you are pregnant, have a medical condition, take medication, or have been inactive. You acknowledge that physical activity involves inherent risks. To the fullest extent permitted by law, you voluntarily assume all risks of injury, illness, or other harm arising from your use of the Platform or any exercise you perform based on it.

Use of the App

You are not permitted to copy, modify, reverse engineer, extract the source code of, translate, or create derivative versions of the App or any part of it. All trademarks, copyrights, database rights, and other intellectual property rights related to VELOX remain the property of the app owner.

Service Changes, Subscriptions & Pricing

We may modify the Platform, introduce new features, or offer paid subscriptions or other paid services. Fees, billing cycles, free trials, and renewal terms are presented in the app or on the applicable app store at the time of purchase. Purchases processed through Apple App Store or Google Play are also subject to that store's terms. Cancellation and refunds follow the store's policies unless mandatory law requires otherwise. We may change pricing or plans with reasonable notice where required by law.

Your Data & Security

VELOX stores and processes personal data you provide in order to deliver the Service. You are responsible for keeping your device and access credentials secure. We strongly recommend that you do not jailbreak or root your device, as this may compromise security and affect app functionality.

Third-Party Services

The Platform relies on third-party services that have their own terms and privacy policies. These include, where applicable:

• Google (e.g. Google Play Services, Firebase, Sign in with Google)
• Apple (e.g. App Store, Sign in with Apple)
• Firebase Analytics and Firebase Crashlytics
• RevenueCat and applicable app stores for purchases

Internet Connection & Usage

Some features of VELOX require an active internet connection. VELOX is not responsible for reduced functionality due to lack of connectivity or data availability. Any data charges incurred are your responsibility.

Device Responsibility

You are responsible for maintaining your device, including keeping it charged and operational. VELOX is not liable for service interruptions resulting from device failure.

Acceptable Use

You agree not to misuse the Platform: no unlawful activity; no attempt to interfere with, disrupt, or gain unauthorized access to our or others' systems or data; no scraping, automated access, or redistribution of the Services at scale without permission; and no harassment or harmful conduct toward others through the Platform. We may suspend or terminate access for violations.

Updates, Maintenance & Termination

We may update the Platform from time to time to improve performance or comply with legal requirements. Continued use of the Platform may require installing updates. We do not guarantee perpetual compatibility with all operating systems. We may suspend or discontinue the Platform or your access where reasonably necessary (for example, for legal, security, or operational reasons). Where feasible, we will provide reasonable notice. Upon termination of your right to use the Platform, provisions that by their nature should survive (including intellectual property, disclaimers, and limitations of liability) will continue to apply.

Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

Limitation of Liability

To the extent permitted by applicable law, VELOX and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Platform, including any injury or health-related claim, even if we have been advised of the possibility of such damages. Where liability cannot be excluded, our total aggregate liability arising out of or relating to the Platform shall be limited to the greater of (a) the amount you paid us for the Platform in the twelve (12) months before the claim, or (b) fifty euros (€50), except where mandatory consumer law in your jurisdiction requires a different outcome.

Governing Law & Disputes

Unless mandatory consumer protection rules in your country of residence require otherwise, these Terms are governed by the laws of the jurisdiction where VELOX's operator has its principal place of business, without regard to conflict-of-law principles. Courts in that jurisdiction have non-exclusive jurisdiction, subject to your statutory rights to sue in your home courts where applicable.

General

If any provision of these Terms is held invalid, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding the Platform and supersede prior discussions, except where the Privacy Policy governs personal data.

Changes to These Terms

We may update these Terms & Conditions from time to time. Any changes will be effective once published on this page. Continued use of the Platform indicates acceptance of the updated Terms.
